Official document:restricting the purchase of domestic products will be drawn into the negative list!

Recently, Meishan Finance Bureau of Sichuan Province issuedNegative list of Meishan municipal government procurement(hereinafter referred to as the”negative list”), based on laws and regulations, fivethree prohibited situations are listed from the aspects of qualification conditions, procurement needs, evaluation factors, etc.

In this list, many items are related to the purchase of imported products. For example, it is forbidden to purchase imported products without approval or demand investigation.

 Item four of Article six of the negative listrequirement,“It is forbidden to take the authorization, commitment, certificate and endorsement of manufacturers other than imported goods as qualification requirements and compliance requirements”.

In other words, it is strictly prohibited to set up unreasonable bidding standards for domestic products, such as manufacturer authorization, commitment, certification, endorsement, etc., as qualification requirements and compliance requirements.

  Item five of Article one0 of the negative listrequirement,“It is forbidden to purchase imported products without approval, or restrict domestic products from participating in competition after approval”.

How to approve? Taking Guangdong Province as an example, in terms of approval procedures, it is proposed that if the products that the purchaser needs to purchase cannot be obtained in China or cannot be obtained with reasonable commercial conditions, and if there is a need to purchase imported products according to laws and regulations, the purchaser should carry out government procurement activities in accordance with the law after obtaining the approval of the financial department.

In other words, it must be imported medical equipment that cannot be obtained in China or can not be obtained under reasonable commercial conditions, otherwise it must give priority to purchasing domestic equipment.

  Article onetwo of the negative listThere are also two restrictions on purchase and import:“Prohibit goods and service projects of more than one0million yuan, engineering procurement projects of more than three0million yuan, and do not carry out demand investigation”,”prohibit projects with complex technology and strong professionalism, including information construction projects that need to be customized and developed, projects that purchase imported products, etc., and do not carry out demand investigation.”

  Item six of Article fourtwo of the negative listClear requirements:“The experts participating in the demonstration of the project of prohibiting the purchase of imported products shall be the evaluation experts of the project”.

According to the measures for the administration of government procurement of imported products, state organs, institutions and organizations using financial funds to purchase imported products (including imported products that have entered China) directly or by commission must conduct expert argumentation in accordance with established procedures, and then report to the higher authorities for filing before purchasing.

It can be seen that the implementation of expert argumentation is one of the important basis for purchasing equipment, and it is very strict. The experts participating in the demonstration shall not participate in the procurement review of the same project as the procurement review experts, so as to prevent the relationship between them from affecting the accuracy of the review.

It is not difficult to find that in recent years, while encouraging the development of domestic equipment, the state has also continued to”restrict” imported products to a certain extent through policy guidance.

However, policy support is only one aspect. What domestic manufacturers need more is to improve their independent R & D and innovation capabilities, strive to study new technologies, meet new market needs, and finally upgrade the domestic equipment industry to high-end manufacturing and gradually break imports.

Otherwise, if the quality can’t keep up, there will still be many bidding agencies exploiting loopholes, not for import, not for big brands, and setting up the guise of bidding discrimination standards to further compress the market space of domestic equipment.

However, we still believe that as more provinces and cities introduce regulatory policies on government procurement, such vicious bidding terms will be strictly prohibited, and domestic equipment will also usher in a fairer market competition environment!

four)采购者和使用者分离的采购项目,未邀请实际使用者参与验收;

five)政府向社会公众提供的公共服务项目,验收时未邀请服务对象参与并出具意见;验收结果未在two个工作日内向社会公告。

six)中标(成交)金额one000万元以上或者复杂的大型政府采购项目,除不属于检测范围的,未邀请国家认可的质量、技术检测机构参与验收。

five)参与需求论证、书面推荐供应商、履约验收、军队采购评审等过程中不依法依规履职;

six)不按规定记录或者反馈采购人或代理机构职责履行情况;

seven)检验复审合格后,不按时办理《证书》续聘盖章;

four)属于同一集团、协会、商会等组织成员的供应商按照该组织要求协同参加政府采购活动;

six)供应商之间商定部分供应商放弃参加政府采购活动或者放弃中标、成交;

seven)供应商与采购人或者采购代理机构之间、供应商相互之间,为谋求特定供应商中标、成交或者排斥其他供应商的其他串通行为;

eight)不同投标人的投标文件由同一单位或者个人编制;

nine)不同投标人委托同一单位或者个人办理投标事宜;

one0)不同投标人的投标文件载明的项目管理成员或者联系人员为同一人;

oneone)不同投标人的投标文件异常一致或者投标报价呈规律性差异;
